COMMISSIONERS PROCEEDINGS

The Banner County Board of Commissioners met in special session on July 12, 2022. This is in accordance with the adjournment of the July 5, 2022, meeting and notice published in the Scottsbluff Star Herald and posting notices in Harrisburg, NE, at the Post Office, the Banner County School, the clerk’s office, and on the front window of the Banner County Courthouse. Proof of publication is on file in the office of the County Clerk and is made a part of the proceedings by reference.

The agenda for the meeting was kept current and was available during the regular business hours at the office of the County Clerk. A copy was emailed to each board member on July 6, 2022. The agenda was not amended less than 24 hours prior to the meeting.

The Chairman called the Special Meeting to order at the hour of 8:37 a.m. with the Pledge of Allegiance. Present on roll call were: Chairman Robert Post; Vice Chairman Robert Gifford; Member Sharon Sandberg; Mark Kovarik, Attorney; Lisa Cross, Clerk; Tom Neal, Highway Superintendent; Tessa Brunner.

The Chairman stated that the open meetings law is posted on the Commissioner meeting room window and that paper copies are available on the table by the door.

The agenda was examined and Gifford moved to approve the agenda. Second by Sandberg. Roll call vote: Post, yes; Sandberg, yes; Gifford, yes.

Public Comments – Deborah Genz asked about the financial end of the grants that Banner County is receiving from NEMA/FEMA. Deborah also inquired about the delays and why there have been delays in the project. There were numerous factors.

ITEMS OF BUSINESS BEFORE THE BOARD

1. Discuss timeline and supplies for culvert work on Road 6, authorize additional equipment, materials or labor necessary to complete repair/hazard mitigation requirements before deadlines. – It was discussed that we have most of the material needed, but do have more material and three culverts that need picked up. It was also discussed what culverts need put in and the possible order that they will be done. There are eight culverts that need put in. There is an auto gate that needs put in on Hendrickson Hill but culverts need to be a priority.

2. Executive session to include Banner County Road Superintendent to prevent the needless injury to the reputation of an individual for evaluation of road department employee job performance.

Sandberg made a motion to go into Executive Session to include Banner County Road Superintendent to prevent the needless injury to the reputations of an individual for evaluation of road department employee job performance. Second by Gifford. Roll call vote: Post, yes; Gifford, yes; Sandberg, yes.

Gifford made a motion to close the Executive Session with no action taken. Second by Sandberg. Roll call vote: Post, yes; Gifford, yes; Sandberg, yes.

9:15 Executive Session Closed – No action taken

Sandberg made a motion to adjourn the special meeting of the Banner County Board of Commissioners at 9:16 a.m. Second by Gifford. Roll call vote: Post, yes; Sandberg, yes; Gifford, yes. The next meeting will be held on July 19, 2022, or at the call of the clerk. A full agenda of the matters to be considered at such date and time is kept continually current and is available for public inspection during normal business hours at the office of the Banner County Clerk in the Courthouse in Harrisburg.

BOARD OF EQUALIZATION PROCEEDINGS

The Banner County Board of Equalization met in special session on July 12, 2022 for Protest Hearings. This is in accordance with the adjournment of the July 5, 2022, meeting and notice published in the Scottsbluff Star Herald and posting notices in Harrisburg, NE, at the Post Office, the Banner County School, the clerk’s office, and on the front window of the Banner County Courthouse. Proof of publication is on file in the office of the County Clerk and is made a part of the proceedings by reference.

The Chairman called the Protest Hearing to order at the hour of 9:30 a.m. with the Pledge of Allegiance. Present on roll call were: Chairman Robert Post; Vice Chairman Robert Gifford; Member Sharon Sandberg; Mark Kovarik, Attorney; Lisa Cross, Clerk; Bernice Huffman, Assessor; Tessa Brunner; John Rutledge.

The Chairman stated that the open meetings law is posted on the Commissioner meeting room window and that paper copies are available on the table by the door.

The agenda was examined and Gifford moved to approve the agenda, striking all reports. Second by Sandberg. Roll call vote: Post, yes; Sandberg, yes; Gifford, yes.

ITEMS OF BUSINESS BEFORE THE BOARD

1. 22-01 – After discussion, Gifford made a motion to change the valuation for John Marvin from $88,840 to $42,580. Second by Sandberg. Roll call vote: Post, yes; Gifford, yes; Sandberg, yes.

2. 22-02 – After discussion, Sandberg made a motion to change the valuation for John Marvin from $38,920 to $29,510. Second by Gifford. Roll call vote: Post, yes; Gifford, yes; Sandberg, yes.

3. 22-03 – After discussion, Gifford made a motion to not change the valuation for Petrowest Energy Company since no information was presented. Second by Sandberg. Roll call vote: Post, yes; Gifford, yes; Sandberg, yes.

Bernice Huffman, Assessor, read the Assessor Certification.

9:45 – Sandberg made a motion to close the hearing. Second by Post. Roll call vote: Post, yes; Gifford, yes; Sandberg, yes. Hearing Closed.

Sandberg made a motion to adjourn the meeting of the Banner County Board of Equalization at 9:46 a.m. Second by Gifford. Roll call vote: Sandberg, yes; Gifford, yes. The next meeting will be held in session on July 19, 2022, or at the call of the clerk.
