Resolution 24 - 07

WHEREAS, Banner County has the power to do all acts in relation to the concerns of the County necessary to the exercise of its corporate powers pursuant to Nebraska Revised Statute 23 - 104(6), and said corporate powers are exercised by the County Board of Commissioners pursuant to Nebraska Revised Statute 23 - 103, and

WHEREAS, Banner County is desirous to implement a more efficient and streamlined way to authorize signatures on financial accounts for newly elected officials and their deputies and designees.

WHEREAS, Banner County is establishing a procedure too effectuate a more orderly transfer of power and authority for financial transaction for its elected Officials, deputies, and their designees to ensure a more efficient government of Banner County.

WHEREAS, Banner County Commissioners, whether elected or appointed shall have authority for access to financial information on all accounts related to Banner Counnty, and shall further have authority to transact business, including check signing authority, on accounts associated with the office of Banner County Commissioner, on behalf of Banner County in their official capacity. Priority to transact in such business shall be given to the Chairperson and Vice Chairman of the Banner County Commissioners, authority to act shall become effective upon the administration of the oath of office, and presentment of the same, along with this resolution and the minutes approving the passage of this resolution to Banner County financial institutions as so designated from time to time.

WHEREAS, Banner County Clerk, whether elected or appointed, and their deputy or designee, shall have authority for access to financial information on all accounts related to the office of Banner County Clerk in the normal course of performance of their duties pertaining to their office, and shall further have authority to transact business, including check signing authority, on accounts associated with the office of Banner County Clerk, on behalf of Banner County in their official capacity. Authority to act shall become effective upon the administration of the oath of office, and presentment of the same, along with this resolution and the minutes approving the passage of this resolution to Banner County financial institutions as so designated from time to time.

WHEREAS, Banner County Treasurer, whether elected or appointed, and their deputy or designee, shall have authority for access to financial information on all accounts related to the office of Banner County Treasurer in the normal course of performance of their duties pertaining to their office, and shall further have authority to transact business, including check signing authority on accounts associated with the offices of Banner County Treasurer, on behalf of Banner County in their official capacity. Authority to act shall become effective upon the administration of the oath of office, and presentment of the same, along with this resolution and the minutes approving the passage of this resolution to Banner County financial institutions as so designated from time to time.

WHEREAS, Banner County Clerk of the District Court, whether elected or appointed, and their deputy or designee, shall have authority for access to financial information on all accounts related to the office of Banner Clerk of the District Court in the normal course of performance of their duties pertaining to their office, and shall further have authority to transact business, including check signing authority, on accounts associated with the office of Banner County Clerk of the District Court on behalf of Banner County in their official capacity. Authority to act shall become effective upon the administration of the oath of office, and presentment of the same, along with this resolution and the minutes approving the passage of this resolution to Banner County financial institution as so designated from time to time.

WHEREAS, Banner County Sheriff, whether elected or appointed, and their deputy or designee, shall have authority for access to financial information on all accounts related to the office of Banner County Sheriff in the normal course of performance of their duties pertaining to their office, and shall further have authority to transact business, including check signing authority, on accounts associated with the office of Banner County Sheriff, on behalf of Banner County in their official capacity. Authority to act shall become effective upon the administration of the oath of office, and presentment of the same along with this resolution and the minutes approving the passage of this resolution to Banner County financial institutions as so designated from time to time.

BE IT RESOLVED by the Board of Commissioners of Banner County, Nebraska, that the elected officials of Banner County, Nebraska whether elected or appointed, and their deputy or designee, shall have authority in the normal course of performance of their duties pertaining to their office to transact business, including check signing authority, on accounts associated with their respective offices, on behalf of Banner County in their official capacities. Authority to act shall become effective upon the administration of the oath of office, and presentment of the same, along with this resolution and the minutes approving the passage of this resolution to Banner County financial institutions as so designated from time to time.

This resolution shall be effective the 4th day of January 2024.

Motion by Anderson. Second by Lease., that the foregoing Resolution be approved and adopted.
