BANNER COUNTY

COMMISSIONERS PROCEEDINGS

The Banner County Board of Commissioners met in regular session on August 2, 2022. This is in accordance with the adjournment of the July 19, 2022, meeting and notice published in the Scottsbluff Star Herald and posting notices in Harrisburg, NE, at the Post Office, the Banner County School, the clerk’s office, and on the front window of the Banner County Courthouse. Proof of publication is on file in the office of the County Clerk and is made a part of the proceedings by reference.

The agenda for the meeting was kept current and was available during the regular business hours at the office of the County Clerk. A copy was emailed to each board member on July 28, 2022. The agenda was not amended less than 24 hours prior to the meeting.

The Chairman called the meeting to order at the hour of 8:45 a.m. with the Pledge of Allegiance. Present on roll call were:

Chairman Robert Post; Vice Chairman Robert Gifford; Member Sharon Sandberg; Mark Kovarik, Attorney; Tessa Brunner, Clerk Assistant; Kathy Natale, Deputy Treasurer; Stan McKnight, Sheriff; Tom Neal, Highway Superintendent.

The Chairman stated that the open meetings law is posted on the Commissioner meeting room window and that paper copies are available on the table by the door.

The agenda was examined and Gifford moved to approve the agenda. Second by Sandberg. Roll call vote: Post, yes; Sandberg, yes; Gifford, yes.

The minutes of the previous meeting had been supplied to each board member. Sandberg moved to approve the minutes for July19, 2022 regular session and that the actions therein be ratified. Second by Gifford. Roll call vote: Post, yes; Gifford, yes; Sandberg, yes.

CORRESPONDENCE - None

CLAIMS - The following claims for August 2, 2022 were audited, and Sandberg moved that the claims be approved and warrants ordered drawn on the respective funds. Second by Gifford. Roll call vote: Post, yes; Sandberg, yes; Gifford, yes.

ITEMS OF BUSINESS BEFORE THE BOARD

1. Janitorial Salary – tabled

2. Zelle HR – tabled

3. Bytes Overview and Proposal – The Banner County’s network assessment was discussed. Our network is at high risk. Bytes proposal was an infrastructure project to secure and control our network. The total cost would be $31,000.00. The proposal is good for 30 days.

4. Discuss Opioid Funds – After some discussion, this was tabled until after the next Region I meeting.

5. Zoom Pricing – The Board of Banner County Commissioner’s are no longer allowed to host a Zoom meeting. The Attorney General is not in favor. The public can do their own meeting, but anyone that is watching cannot participate, they can only watch. The District Court is allowed to use Zoom.

6. Set Pre-Budget Workshop – Sandberg made a motion to set the Pre-Budget Workshop for August 12, 2022 at 8:45 am. Second by Gifford. Roll Call Vote: Post, yes; Gifford, yes; Sandberg, yes.

7. Declare vacancy in the office of the County Treasurer and set interviews – As a result of Monty Stoddard’s resignation, there is a vacancy in the Treasurer’s Office for Treasurer. The Deputy Treasurer, Kathy Natale, will step into the position of the Treasurer until one is appointed. We have opened the position to applications and will set interviews up for the next Commissioner Meeting on August 16, 2022. This item is tabled until after reports.

8. ORION – Pronghorn Flats Wind Farm Development Agreement and Pronghorn Flats Wind Farm County Road Use, Repair and Maintenance Agreement – After a little discussion, this item was tabled because it was suggested that there was a town hall meeting to address these agreements and have time to review. Suggestion was made to have a town hall meeting to address tax payers concerns.

9. Leo Hoehn – Letter from County Weed Superintendent – Leo Hoehn didn’t come.

10. Don and Dena Cashler – Don and Dena Cashler are unhappy due to roads not being maintained and big rocks on the road. The telephone line was damaged when the culvert by their house was put. Don and Dena are maintaining the weeds in the ditch, but when the road is graded they push all the weeds from the other side of the road’s ditch into theirs. Both Tom Neal, Highway Superintendent, and Steve Baird, Weed Superintendent are going to work with them.

2. Zelle HR – The contract is for $4,000.00 per month for six months. Gifford made the motion to enter into contract with

Zelle. Second by Sandberg. Roll Call Vote: Post, yes; Gifford, yes; Sandberg, yes.

7. Declare vacancy in the office of the County Treasurer and set interviews – The names of the applicants that were

selected for an interview on August 16, 2022 at 8:45am are as follows: Holly Reichenberg, Chelsea Mossberg,

Lorraine DiBattista, and Kathy Natale. Sandberg made a motion to do the interviews on August 16, 2022 at 8:45 am.

Second by Gifford. Roll call vote: Post, yes; Gifford, yes; Sandberg, yes.

REPORTS

Highway Department – Tom Neal, Highway Superintendent, reported they have four of the eight culverts installed. They have three sites left and they are starting those next.

Weed Superintendent – Steve Baird, Weed Superintendent, presented a copy of the thistle letter. People are not happy with the letter. Most people are waiting until September to spray.

County Attorney – Mark Kovarik, County Attorney, County Court is August 3, 2022. District Court is August 4, 2022.

Treasurer - Deputy Treasurer, Kathy Natale, will be stepping in to the Treasurer position until one is appointed. There is a new hire, Amber Ysac, to help in the Treasurer’s Office. They are working on tax collection and budget.

Sheriff – Stan McKnight, Sheriff, reported that the stakes for the impound lot are in. He was just looking at doing half of the lot, but that is not big enough. Possible two estimates for the entire lot will be coming in.

Public Comments –

Robin Darnall – Robin Darnall would like a town hall meeting with ORION. There is a concern of us losing control of our roads.

Kathy VanPelt – Kathy VanPelt wanted to know if Kimball County has any problems.

Barb Cross – Barb Cross wanted to know if Banner County was going to do background checks on the applicants for the treasurer position.

LeAnn Trompke – LeAnn Trompke reported there was a huge soft spot on Road 57. She would like Tom to look at it and flag it.

Sandberg made a motion to adjourn the meeting of the Banner County Board of Commissioners at 11:20 a.m. Second by Gifford. Roll call vote: Post, yes; Sandberg, yes; Gifford, yes. The next meeting will be held in regular session on

August 16, 2022, or at the call of the clerk. A full agenda of the matters to be considered at such date and time is kept continually current and is available for public inspection during normal business hours at the office of the Banner County Clerk in the Courthouse in Harrisburg.
