BANNER COUNTY

BOARD OF EQUALIZATION PROCEEDINGS

The Banner County Board of Equalization met in regular session in the Commissioners’ room of the Banner County Courthouse on September 17, 2019. This is in accordance with the adjournment of the September 3, 2019 meeting and notice published in the Scottsbluff Star Herald and posting notices in Harrisburg, NE at the Post Office, the Banner County School, at the clerk’s office, and on the front window of the Banner County Courthouse. Proof of publication is on file in the office of the County Clerk and is made a part of the proceedings by reference.

The agenda for the meeting was kept current and was available during the regular business hours at the office of the County Clerk. A copy was emailed to each board member on September 12, 2019. The agenda was not amended less than 24 hours prior to the meeting.

The chairman called the meeting to order at the hour of 8:30 a.m. Present on roll call were: Chairman Robert Post; Vice Chairman Robert J. Gifford; Member Sharon Sandberg; Bernice Huffman, Assessor; Travis Rodak; Mark Kovarik; Jim Zimmerman, Attorney; Tom Neal, Highway Superintendent; Jay Dove, and Lori Hostetler, Clerk.

The chairman stated that the open meetings law is posted on the meeting room window and that paper copies are available on the table by the door.

The agenda was examined, and Gifford moved to approve as presented. Second by Sandberg. Roll call vote: Post, yes; Gifford, yes; Sandberg, yes.

The minutes of the previous meeting had been supplied to each board member. Sandberg moved to approve the minutes for September 3, 2019 and that the actions therein be ratified. Second by Gifford. Roll call vote: Sandberg, yes; Post, yes; Gifford, yes.

ITEMS OF BUSINESS BEFORE THE BOARD

Item #1 – Tax list corrections – Bernice Huffman, Assessor presented 2 tax list corrections for approval. After review, Gifford made a motion to approve tax list corrections 18-2 and 18-3. Second by Sandberg. Roll call vote: Post, yes; Faden, yes; Gifford, yes.

Gifford made a motion to adjourn the Banner County Board of Equalization meeting at 8:37 a.m. Second by Sandberg. Roll call vote: Post, yes; Sandberg, yes; Gifford, yes. The next meeting will be held in regular session on October 1, 2019 or at the call of the clerk. A full agenda of the matters to be considered at such date and time is kept continually current and is available for public inspection during normal business hours at the office of the Banner County Clerk in the Courthouse in Harrisburg.

Also present at various times: Sheila Newell and Dave Wolf.

The chairman stated that the open meetings law is posted on the meeting room window and that paper copies are available on the table by the door.

Due to increased attendance, meeting was moved to the courtroom.

The agenda was examined and Gifford moved to approve as presented. Second by Sandberg. Roll call vote: Sandberg, yes; Gifford, yes; Post, yes.

CORRESPONDENCE

Letter informing that the generator project has been approved by FEMA. The letter did not list the correct entity that received approval, so the county is waiting for a corrected notification.

The following claims were audited, and Gifford moved that the claims be approved and warrants ordered drawn on the respective funds. Second by Sandberg. Roll call vote: Gifford, yes; Sandberg, yes; Post, yes.

ITEMS OF BUSINESS BEFORE THE BOARD

Item #1 – Consider and adopt Resolution - Signing of the County Annual Certification of Program Compliance Form 2019 – Post read the resolution into record. Gifford made a motion to adopt the Resolution for the Signing of the County Annual Certification of Program Compliance Form 2019. Second by Sandberg. Roll call vote: Post, yes; Sandberg, yes; Gifford, yes.

REPORTS

COMMITTEE REPORTS

Aging Office had vehicles damaged by hail. They have decided to just replace the glass in the vehicles and use the extra insurance money to start a car fund.

Office of Human Development also had vehicles damaged by hail.

Gifford attended the Safety and Wellness Seminar. Banner County School and the Public Health District received awards. He said that NIRMA will pay the dues if the county wants to join the NE Safety Council.

HIGHWAY SUPERINTENDENT

Tom Neal, Highway Superintendent reported that they are graveling the Mosher road. He said the FEMA Program manager has asked to change the date for their next meeting, and site inspections will be done again.

ATTORNEY

Jim Zimmerman, Attorney reported that he had spoken to Eubanks about doing traffic court and the 1st meeting in October if a county attorney has not been appointed. He said there would need to be discussion on compensation. Zimmerman said this was his last meeting as county attorney, and the commissioners wished him well.

TREASURER

Monty Stoddard, Treasurer presented the pledged collateral report. He said He and Kathy have been doing training on the DMV program, and the December Conference dates will be longer this year to address more topics. He also said tax collections went well.

CLERK

Lori Hostetler, Clerk presented the clerk and the clerk of the district court fee reports. She reported that the budget has been submitted and said there was an usually high amount of recording activity last month.

Item #2 – Representative for Congressman Adrian Smith - Val Jansante - 9:15 – Val Jansante introduced himself as Congressman Smith's new representative and welcomed any questions or concerns.

Item #3 – Public hearing on partial vacation of CR 61 - 10:00 a.m. – The chairman called the hearing to order at 10:00 a.m. Those present for hearing: Chairman Robert Post; Vice Chairman Robert J. Gifford; Member Sharon Sandberg; Bernice Huffman, Assessor; Travis Rodak; Mark Kovarik; Jim Zimmerman, Attorney; Tom Neal, Highway Superintendent; Jay Dove; Monty Stoddard, Treasurer; Lisa Brenner; Robert Brenner; Gary Darnall, Val Jansante; Sheila Newell; Dave Wolf, and Lori Hostetler, Clerk.

Testimony was heard.

The chairman closed the hearing at 10:03 a.m.

Item #4 - Discussion and possible action on the partial vacation of CR 61 – Gifford made a motion to adopt the resolution for the partial vacation of CR 61. Second by Sandberg. Roll call vote: Post, yes; Sandberg, yes; Gifford, yes.

Item #5 – Review and possible action on resumes received for the county attorney position – The commissioners heard from the 3 attorneys who had submitted resumes for the county attorney position: Travis Rodak; Mark Kovarik, and Robert Brenner. After discussion; Sandberg made a motion to appoint Mark Kovarik as county attorney for the remainder of the term since he had run for the position in the last election and showed interest in the position. Second by Gifford. Roll call vote: Gifford, yes; Post, yes; Sandberg, yes.

Gifford made a motion to adjourn the meeting of the Banner County Board of Commissioners at 10:24 a.m. Second by Sandberg. Roll call vote: Sandberg, yes; Post, yes; Gifford, yes. The next meeting will be held in regular session on October 1, 2019 or at the call of the clerk.
