BOARD OF EQUALIZATION PROCEEDINGS

The Banner County Board of Equalization met in regular session in the Commissioners’ room of the Banner County Courthouse on October 1, 2019. This is in accordance with the adjournment of the September 17, 2019 meeting and notice published in the Scottsbluff Star Herald and posting notices in Harrisburg, NE at the Post Office, the Banner County School, at the clerk’s office, and on the front window of the Banner County Courthouse. Proof of publication is on file in the office of the County Clerk and is made a part of the proceedings by reference.

The agenda for the meeting was kept current and was available during the regular business hours at the office of the County Clerk. A copy was emailed to each board member on September 30, 2019. The agenda was not amended less than 24 hours prior to the meeting.

The chairman called the meeting to order at the hour of 8:30 a.m. Present on roll call were: Chairman Robert Post; Vice Chairman Robert J. Gifford; Member Sharon Sandberg; Bernice Huffman, Assessor, Mark Kovarik, Attorney; Tom Neal, Highway Superintendent; Jay Dove, and Lisa Cross, Deputy Clerk.

The chairman stated that the open meetings law is posted on the meeting room window and that paper copies are available on the table by the door.

The agenda was examined, and Sandberg moved to approve as presented. Second by Gifford. Roll call vote: Post, yes; Gifford, yes; Sandberg, yes.

The minutes of the previous meeting had been supplied to each board member. Gifford moved to approve the minutes for September 17, 2019 and that the actions therein be ratified. Second by Sandberg. Roll call vote: Sandberg, yes; Post, yes; Gifford, yes.

ITEMS OF BUSINESS BEFORE THE BOARD - None

Gifford made a motion to adjourn the Banner County Board of Equalization meeting at 8:45 a.m. Second by Sandberg. Roll call vote: Post, yes; Sandberg, yes; Gifford, yes. The next meeting will be held in regular session on October 15, 2019 or at the call of the clerk. A full agenda of the matters to be considered at such date and time is kept continually current and is available for public inspection during normal business hours at the office of the Banner County Clerk in the Courthouse in Harrisburg.

CORRESPONDENCE

Letter informing that the generator project has been approved by FEMA. The letter did not list the
correct entity that received approval, so the county is waiting for a corrected notification.

The following claims were audited, and Sandberg moved that the claims be approved and warrants ordered drawn on the respective funds. Second by Gifford. Roll call vote: Gifford, yes; Sandberg, yes; Post, yes.

PUBLIC COMMENTS – A welcome was extended to the new County Attorney.

ITEMS OF BUSINESS BEFORE THE BOARD

Item #1 –Review and sign all required forms of the generator grant -
REPORTS – The County Attorney looked over the forms and agreed they were good to be signed.  There was discussion on what type of generator (diesel or propane) the county would want.  Decision was made to stick with the diesel.  Sandberg moved to approve the grant #DR4375-NE-0005.  Second by Gifford.  Roll call vote:  
Gifford, yes; Post, yes; Sandberg, yes.  


Item #2 – Possible action on contract with Mark Kovarik as County Attorney – Mark Kovarik prepared a contract between the county and himself for County Attorney.  A letter of acceptance will be signed in addition to the contract.   Gifford made a motion to accept the contract and sign the letter of acceptance.  Second by Sandberg.  Roll call vote:  Gifford, yes; Post, yes; Sandberg, yes. 

Item #3 – Review state statutes regarding County Clerk position – After discussion, it was declared there was a vacancy for the County Clerk position.  The Deputy County Clerk will temporarily fill the vacancy.  It was also discussed that it would be a possibility to hire Lori Hostetler to consult and help with further training.  The board has 45 days to fill the position permanently. 

Item #4 – Discuss and possible action on procedure to appoint County Clerk – It was decided that it would be best to advertise for the position of County Clerk.  The board will accept applications until
November 1, 2019.  Sandberg made a motion to advertise.  Second by Gifford.  Roll call vote:  Sandberg, yes; Gifford, yes; Post, yes.


COMMITTEE REPORTS

Emergency Management wanted to let everyone know that they can attend training.  FEMA courses for local government will be held on October 15 & October 22nd at the 21st Century Training Center in Bridgeport. 

HIGHWAY SUPERINTENDENT
Tom went to the district meeting.  There is a new LTAP Director.  They are part of UNL and have no heavy equipment operators due to budget cuts.  They will train people in the locality of where they live and then they will train the other employees. There is a flagger & temporary road closure training on October 18th.  All road personnel are enrolled.  They have been doing site inspections with FEMA.  They have around half of them done.

ATTORNEY
Mark stated his first day of court is October 2, 2019 for County Court and October 2, 2019 for District Court.  He will be attending a County Attorney continuing education class on October 9-11, 2019. 



TREASURER
The pledged collateral report was handed out and approved.  Per state statute Monty sent out personal property reminders.  He will be attending the 10th Legislative Conference in McCook.  The new system for the DMV is starting October 15, 2019.  The auditor will be here then also.  There are upcoming accreditation opportunities for all elected county offices.  There will be allocation workshop at NACO convention in December.


CLERK
The auditor is coming around October 15th.  We have hired a new person to help out in the office.  There will be an election workshop October 23-25, 2019.
