BANNER COUNTY
BOARD OF EQUALIZATION PROCEEDINGS

The Banner County Board of Equalization met in regular session in the Commissioners’ room of the Banner County Courthouse on July 3, 2018. This is in accordance with the adjournment of the June 19, 2018 meeting and notice published in the Scottsbluff Star Herald and posting notices in Harrisburg, NE at the Post Office, the Banner County School, and at the clerk’s office and on the front window of the Banner County Courthouse.  Proof of publication is on file in the office of the County Clerk and is made a part of the proceedings by reference.

The agenda for the meeting was kept current and was available during the regular business hours at the office of the County Clerk.  A copy was emailed to each board member on June 29, 2018.  The agenda was not amended less than 24 hours prior to the meeting.

The chairman called the meeting to order at the hour of 8:30 a.m. Present on roll call were: Chairman John-Robert Faden; Vice Chairman Robert J. Gifford; Member Robert Post; Tom Neal, Highway Superintendent, and Lori Hostetler, Clerk. 

The chairman stated that the open meetings law is posted on the meeting room wall and that paper copies are available on the table in the corner of the room.

The agenda was examined, and Gifford moved to approve as presented. Second by Faden. Roll call vote: Post, yes; Gifford, yes; Faden, yes.

The minutes of the previous meeting had been supplied to each board member. Gifford moved to approve the minutes for June 19, 2018 and that the actions therein be ratified. Second by Faden. Roll call vote: Post, yes; Faden, yes; Gifford, yes.

ITEMS OF BUSINESS BEFORE THE BOARD 

CORRESPONDENCE - None

Item #1 – Set additional date for protest hearings – Gifford made a motion to set an additional date for protest hearings as July 24, 2018 @ 8:30 a.m. Second by Faden Roll call Post, yes; Faden, yes; Gifford, yes. 

Gifford made a motion to adjourn the Banner County Board of Equalization meeting at 8:43 a.m.  Second by Post. Roll call vote: Post, yes; Faden, yes; Gifford, yes. The next meeting will be held in regular session on July 17, 2018 or at the call of the clerk.  A full agenda of the matters to be considered at such date and time is kept continually current and is available for public inspection during normal business hours at the office of the Banner County Clerk in the Courthouse in Harrisburg.

ITEMS OF BUSINESS BEFORE THE BOARD 

Item #3 – Discussion of possible dates for budget workshop – There was discussion of possible dates. The end of July is preferable, if possible.

Item #2 – Don Cashler – Discussion of concern regarding weeds - Don Cashler discussed problems with several noxious weeds that are spreading to his property. There was discussion on what the county does to help control them and what responsibility the landowner has.

Item #1 – Discussion of Extension Assistant/Office Manager position – Karen DeBoer asked for the support of the commissioners in hiring to fill the vacancy of the Extension Assistant/ Office Manager position. Support was given, and the position will be advertised.

Item #4 - Discussion and possible action on request from company to publish images from Nebraska Deeds Online – After reviewing a letter requesting to publish images from NE Deeds Online, it was decided that the county attorney and NACO’s legal counsel would be consulted before making a decision.

Item #5 – Discussion of possible Interlocal Agreement between Kimball County and Banner County for Banner County District Court services – Lori Hostetler, Clerk expressed concern over the growing number of district court cases being filed. She said many cases are regarding severed mineral rights, and there is a lack of detailed instruction on how to process and enter them into the justice system. She said that Deb Diemoz with Kimball County District Court has been a huge help because of her extensive experience. A possible interlocal agreement with Kimball County was reviewed. After discussion, it was decided that it was not an option the commissioners wanted to pursue, but they would like to know how other counties with similar situations handle the District Court. 

Item #6 – Discussion of possible building improvement projects – There was discussion on possible building improvements to be considered when working on the budget. 

REPORTS 

COMMITTEE
Robert Post confirmed that Panhandle Public Health Group is now closed.

WEED
Cris Burks, Weed Superintendent reported that all county roads have been sprayed. She said that she is seeing Dalmatian Toadflax in the western part of the county.

HIGHWAY SUPERINTENDENT
Tom Neal, Highway Superintendent reported that they are still working on Road 6. He said they are done spraying Harrisburg. He also reported that the employee hired a month and a half ago has quit.

TREASURER
Monty Stoddard, Treasurer reported that he will be receiving training in October for the new DMV system which will be implemented next year.

CLERK
Lori Hostetler, Clerk reported that she is preparing for protests and budget.

Gifford made a motion to adjourn the meeting of the Banner County Board of Commissioners at 10:33 a.m.  Second by Post.  Roll call vote: Post, yes; Faden, yes; Gifford, yes.
